Court Pauses Minnesota AI Nude Ban
The U.S. Court of Appeals for the Eighth Circuit on 2 October temporarily blocked Minnesota’s first-in-the-nation ban on AI “nudification” tools while Elon Musk’s xAI pursues a First Amendment challenge, reversing a lower court’s refusal to pause the August law.

St. Louis — The U.S. Court of Appeals for the Eighth Circuit on 2 October granted Elon Musk’s xAI a temporary injunction that pauses Minnesota’s ban on AI tools that create fake nude images of real people, while the company argues the statute violates the First Amendment.
The St. Louis-based appeals court put the law on hold for now. U.S. District Judge Donovan Frank had refused emergency relief last month, saying xAI had not shown irreparable harm and had waited too long to sue. The Eighth Circuit’s order does not decide whether the law is constitutional; it only stops enforcement while the challenge proceeds.
What Minnesota banned
Minnesota’s anti-“nudification” law took effect on 1 August. It prohibits website operators, software developers, and others from allowing users to create realistic images that depict an intimate body part not shown in an original photo of an identifiable person. State officials said the measure targets nonconsensual sexual deepfakes and pointed to harms from AI products that can strip clothing from photographs. Attorney General Keith Ellison’s office said Friday it was disappointed and will keep defending the law, calling nudification a vile form of harm and harassment.
xAI, which builds the Grok chatbot and related image tools, says the statute restricts protected speech. In its appeal the company disputed the delay finding and said Grok Imagine includes protections against creating nudified or sexualized images of real people. xAI has also sued users it alleges evade those blockers to make sexual images without consent.
How nudification tools work
“Nudification” software takes an ordinary photo of a clothed person and uses generative AI to produce a realistic image that appears to show that person undressed. Victims often have no warning; the output can be shared online within minutes. Minnesota lawmakers framed their ban as a consumer-protection and privacy rule aimed at that pipeline, especially where the technology is marketed to undress identifiable people. Free-speech challengers argue that broadly written bans on image-generation tools can sweep in protected satire, fiction, or adult content involving consenting adults, and that existing harassment, revenge-porn, and child-exploitation statutes already cover the worst abuses. The Eighth Circuit’s pause keeps that clash alive without yet picking a winner.
Why the pause matters
A temporary appellate injunction is an emergency brake, not a final win. Minnesota can still defend the statute on the merits; xAI still has to persuade judges that the First Amendment bars this particular ban. Other states are watching because Minnesota billed the law as a first-of-its-kind model for policing AI image tools that undress real people without consent.
For users and platforms, the immediate effect inside Minnesota is that the August ban is not enforceable while the Eighth Circuit’s pause lasts. For the wider AI industry, the fight is an early appellate test of how far states may go in outlawing a category of generative-image conduct when companies claim speech protections and say they already police misuse.
